Terms of Service

1. The Service

ThanksImHired provides software tools designed to help job seekers identify local businesses, generate personalised outreach emails using third-party artificial intelligence, and send those emails through the user's own connected Gmail account.

We provide the platform and the tools only. We do not send emails on your behalf. You are the sender of every email generated or processed through our service, and you maintain full control over your outreach campaigns.

2. Eligibility

To use ThanksImHired, you must be at least 18 years old and a resident of the United Kingdom, or otherwise comply with the laws of your local jurisdiction. You are permitted only one account. Automated sign-ups or accounts created by "bots" are strictly prohibited.

3. User Responsibilities and Conduct

This service handles data and communication. Your compliance with the law is your sole responsibility.

• Content and Compliance: You are exclusively responsible for the content of every email you send. You must ensure your use of the service complies with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations 2003 (PECR).
• PECR and Consent: Under UK law, you must not send unsolicited direct marketing emails to individuals or sole traders without their prior "opt-in" consent. You acknowledge that you understand this legal requirement and agree to abide by it.
• Prohibited Use: You must not use the service to send spam, harass any individual, or contact any business that has previously requested not to be contacted.
• Data Accuracy: Business contact data is sourced from publicly available information. This data may be inaccurate, out of date, or incorrect. You accept full responsibility for verifying the accuracy and appropriateness of any contact data before sending an email.
• Data Controller Status: For the purposes of data protection law, you are the Data Controller for any personal or business contact data you process, scrape, or contact through ThanksImHired.

4. Your Account and Security

Your account is accessed via Google OAuth. You are responsible for maintaining the security of your Google account and for all activity that occurs under your ThanksImHired profile. We reserve the right to suspend or terminate your access if we suspect any breach of these terms or any unauthorised use of your account.

5. Intellectual Property

We own all rights, title, and interest in ThanksImHired, including the code, design, branding, and original content. We grant you a limited, non-exclusive, non-transferable licence to use the service for your personal job search.

The emails you generate are yours. However, AI-generated content is provided "as is". We make no claims of ownership over the specific text generated by the AI for your emails, nor do we guarantee that such content is unique or free from third-party intellectual property claims.

6. Acceptable Use

You must use the service fairly. You agree not to:

• Bypass or attempt to circumvent any rate limits or security measures.
• Use any automated system, such as "scrapers" or "robots," to access the service in a manner that sends more request messages to our servers than a human can reasonably produce in the same period.
• Reverse engineer, decompile, or attempt to extract the source code of the service.
• Use the service for any illegal purpose or to promote illegal activities.

7. Limitation of Liability

To the maximum extent permitted by law, Dylan Byrne shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

• "As Is" Basis: The service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.
• No Guarantees: We do not guarantee that your emails will be delivered, that recipients will respond, or that your use of the service will result in a job offer or employment.
• Third-Party Actions: We are not liable for any actions taken by Google against your Gmail account, including suspension or permanent banning, resulting from your use of this service.
• Regulatory and Legal Risk: We are not liable for any regulatory fines, legal claims, or damages arising from your failure to comply with PECR, GDPR, or any other communication laws.
• Liability Cap: Our total liability to you for any claim arising out of or relating to these Terms or the use of the service shall not exceed the total amount paid by you to us in the 12 months immediately preceding the event giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Dylan Byrne from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of and access to the service.
• Any email campaigns you conduct.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including any privacy or intellectual property right.
• Your violation of any applicable law, including but not limited to PECR and UK GDPR.

9. Data and Privacy

Your privacy is important. Our Privacy Policy explains how we handle your data and your Google account permissions. By using ThanksImHired, you acknowledge that you have read and understood our Privacy Policy.

10. Termination

You may stop using the service and delete your account at any time. We reserve the right to terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the service will cease immediately.

11. Changes to Terms

We may update these Terms from time to time to reflect changes in the law or our service. We will notify you of any material changes by posting the new Terms on this page. Your continued use of ThanksImHired after such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms and any dispute or claim arising out of them shall be governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of these Terms.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in full force and effect.
